Amministrazione delle Finanze v Simmenthal SpA.

This is a 1978 case about conflict of national legal system

Beef was imported from France to Italy

Italy imposed public health inspection pursuant to a 1970 law

This clased with EEC regulations of 1964 ad 1968.

It was held that EU law took precedence over Italian law.

timing of Italian law was irrelevant. community law too priority.

About Calers

Born Belfast 1971. I read history at Edinburgh. I did a Master's at UCL. I have semi-libertarian right wing opinions. I am married with a daughter and a son. I am allergic to cats. I am the falling hope of the not so stern and somewhat bending Tories. I am a legal beagle rather than and eagle. Big up the Commonwealth of Nations.
