ECJ sid the lack of contract between the transderor and transferee is not conclusive

in order to determine whether an enterprise has been transferred one must consider many factors

the type of undertaking

whether it has assets

do those assest change hands?

are most employees taken over by a new employer

are the customers transferred

are the activiies similar before and after

are any activities suspended

 

 

the identity oof a ompany does not end when it is transferred
