Spijker worked for a slaughterhouse. the company was then transferred to Benedik

only SPijker and one other were not reteained

the business started to do badly

the company went bust in 1983

is the employee in a psotion whereby he can carry on the bsuiness as before for the transferee of the same

the ECJ said the key question os whether the company changes identity or not. does it keep the same assets, good weill , customers and so forth.
