RWE vertrieb AG v Verbraucherzentral Nordrhein Westfalen AV

2013. consumer proteection. inequaluty in bargaining power

imbalances in information’ RWE vertrieb AG provided natural gas in special contracts and standard contracts

tariffs could be varied for one sort of contract but not the other. tariffs were soemtimes set by national law.

The company varired the price without reason or explanation

consemrs could accept the changes or change supplier

it was v hard to change provider

the right to terminate the contract must be easy to exercise. a theorteitcal right is not good enough

the consuemrs must be given sufficient warning of such changes. this is because the consumers had less bargaiingin power and less knowlwedg of thw market
