Badeck was erstwhile attorney general for Hesse

badeck was a politician in Hesse. He wnated to review the positive actions measures needed to appoint official tot the s federal

state cabinet,

it was argued that this violated the Grundgesezt principle to ensure the best person for the job was appointed and it clashed with the Equal Treatemtn Directive from the EU on

ECJ said prioritty for under represented groups could be allowed but such preference was not automatic

certain measures were specifically allowed such as

gaurnateeting an interview to an ewual number of women and men

preference for women and quotas for women in some sectors
