right to strike cN INfringe freedom of establishment

Rosella wa sa ship that plied its way betwene Finland and Estonia

The ship was reflagged for financial reason

Intl tarnsport worker fed opposed this

Finnish seamen’s union planned a strike,

the Viking line sought an injunction in English courts and got it

court of appeal overturned the injunction on balance of convenience


ECJ said it was for national courts to determine the matter att hand but in prtinciple a strike can infringe freedom of estbalieh,ent

there is a right to strile when livelohood is threatened but this must be exervised within reasinable limitations
