North Sea Continental Shelf. 1969


This was a series of cases about an area of the sea.

The Netherlands and Germany hotly contested them because of the oil there.

Areas of the sea are usually given to the country nearest thereto.

The Netherlands has a convex coastline whereas Germany;s is concave which disadvatanges Germany

Germany argued the length of coastline should be taken into account

The Netherlands got most of the disputed sea.

equity can be praeter legem –  that is beyond law.
